Work Authorization Framework

Employment is governed by the Fair Work Act 2009, Australian immigration legislation, and social security rules. Australian citizens and permanent residents may work freely. New Zealand citizens generally have unrestricted work rights under the Special Category Visa (Subclass 444). Most other foreign nationals must hold a valid visa with work rights before starting employment.

Types of Work Visas

Common pathways include Temporary Skill Shortage (Subclass 482), Employer Nomination Scheme (Subclass 186), Skilled Independent (Subclass 189), Skilled Nominated (Subclass 190), and Temporary Graduate (Subclass 485). Employer-sponsored visas are often granted for up to 4 years; permanent visas provide unrestricted work rights.

Employer Obligations

Employers must verify work rights through VEVO, offer genuine positions that meet market salary requirements, and ensure contracts comply with Fair Work rules. Employment may begin only after visa grant, TFN registration, and payroll onboarding. Non-compliance can lead to civil penalties and immigration sanctions.

Working Conditions (NES)

The National Employment Standards apply to local and lawfully employed foreign workers. A standard full-time week is 38 hours, with a minimum of 4 weeks paid annual leave. Overtime, breaks, and additional leave depend on Modern Awards, enterprise agreements, or the employment contract.

How the System Works

Australia does not use a single PRSI-style payroll social security levy. Protection is split across compulsory employer superannuation, Medicare, Centrelink income-support payments, and state/territory workers’ compensation schemes, administered mainly by the ATO, Services Australia, and state authorities.

Superannuation Guarantee

The employer Superannuation Guarantee is 12% of eligible ordinary earnings (from 1 July 2025). There is no general mandatory employee social security contribution. From 1 July 2026, Payday Super generally requires contributions to reach the employee’s fund within seven business days after payday.

Registration & Payroll

Employees generally need a Tax File Number. Employers report salary, tax, and super through Single Touch Payroll, enrol staff in a complying super fund, and hold workers’ compensation insurance. Foreign employees must have verified work rights; most temporary workers still receive compulsory super.

Medicare & International Agreements

Medicare eligibility depends on residency, visa category, and Reciprocal Health Care Agreements. Staff who are not Medicare-eligible may need private or OVHC cover. Australia’s bilateral social security agreements can help avoid double contributions and coordinate pension periods.

PAYG Withholding

The ATO administers employment tax. Employers withhold income tax under PAYG, report through Single Touch Payroll, and remit to the ATO. Income tax is progressive: a tax-free threshold of AUD 18,200 for residents and indicative marginal rates of 15%–45%, depending on residency and taxable income.

Other Payroll Obligations

Besides income tax, payroll may include the Medicare levy, compulsory superannuation, and study/training loan repayments. Employers may also face BAS reporting, payroll tax, Fringe Benefits Tax, and corporate tax obligations. Missing a TFN can trigger withholding at the highest rate (up to 47% for residents).

Tax Residency

Residency is tested under the resides, domicile, 183-day, and Commonwealth superannuation tests. Australian tax residents are generally taxed on worldwide income. Foreign residents are usually taxed only on Australian-sourced income and typically do not receive the tax-free threshold.

DTAs + Termination Tax

Australia’s Double Taxation Agreement network can prevent double tax and support foreign tax credits. Genuine redundancy payments may be partly tax-free within limits; ETPs can receive concessional treatment; unused leave is generally taxable and must be reported correctly through STP.

Termination Framework

Termination is regulated by the Fair Work Act 2009, the NES, Modern Awards, enterprise agreements, and contracts. Rules apply equally to Australian and lawfully employed foreign staff. Lawful dismissal needs a valid reason, procedural fairness, and proper documentation.

Probation + Unfair Dismissal

Probation commonly lasts 3–6 months. Some unfair-dismissal protections may not apply until the qualifying period is met, but contractual and workplace laws still apply. Eligible employees can challenge a harsh, unjust, or unreasonable dismissal at the Fair Work Commission.

Statutory Notice Periods

NES minimum employer notice is 1 week (up to 1 year of service), 2 weeks (1–3 years), 3 weeks (3–5 years), and 4 weeks (more than 5 years). Employees aged 45+ with at least two years’ service generally receive one extra week. Payment in lieu may be used where permitted.

Redundancy & Final Pay

Genuine redundancy can trigger statutory redundancy pay of 4–16 weeks’ ordinary pay, subject to service length and exemptions. Employers must complete final payroll, PAYG/STP reporting, outstanding super, and—for visa holders—align the exit with immigration and sponsorship obligations.

Public Schools

Schooling generally runs for 13 years from Foundation/Prep to Year 12. Public schools follow the Australian Curriculum and teach in English, with language support available. Tuition is generally free for citizens and permanent residents; some temporary visa holders pay state or territory fees.

International Schools

Major cities—Sydney, Melbourne, Brisbane, Perth, Adelaide, and Canberra—offer IB, Cambridge, British, American, and other international curricula. These schools suit globally mobile families who need curriculum continuity or a pathway to study abroad.

Private & Catholic Schools

Independent and Catholic schools offer English-language instruction, strong academics, religious or non-denominational options, and day or boarding places. Families often choose them for smaller classes, extracurricular breadth, or university preparation.

Early Years & Enrollment

Centre-based day care, family day care, preschool/kindergarten, and Child Care Subsidy support are widely available. Enrollment typically requires proof of identity, visa/residency status, immunisation history, and previous school records where relevant.

Public Healthcare (Medicare)

Medicare and state/territory public hospitals cover GPs, emergency and inpatient care, specialist referrals, maternity and paediatric services, mental health support, and subsidized medicines through the PBS. Access depends on Medicare eligibility, visa category, and reciprocal agreements.

Private & Expat Clinics

Private hospitals and clinics offer greater choice of doctor, shorter waits for some procedures, private rooms, and broader allied-health cover. Major cities have international-standard facilities used by residents, expatriates, and globally mobile families.

Insurance Requirements

Private health insurance is optional for many residents but may be required or strongly recommended for temporary visa holders. Employers sometimes offer cover as a benefit. Staff without Medicare access typically need private or overseas visitor health insurance.

Emergency & Medicines

Emergency care is available nationwide via 000. Public and private pharmacies are widely accessible, with many prescriptions subsidized under the PBS for eligible patients. Regional communities also use community health centres and telehealth.

Paid Public Holidays

National public holidays observed across Australia. Some dates vary by state or territory, and additional local holidays may apply.
